JFL is the pseudonym used for the design, creation and production of works by artist Jean-François LECOCQ whose place of residence is in France.
Jean-François LECOCQ produces, reproduces and sells his own works of art and guarantees the authenticity of his original works or reproduced by his services or by a duly authorized third party. The signatures of the work and the certificate of authenticity, accompanying it obligatorily, are proof of it. It is agreed in all cases that the artist remains fully and unconditionally the owner of all his copyright. The artist wishes to preserve the integrity and clarity of the artist's ideas and conceptions as to his work and to this end he takes into account the wishes and opinions that he may issue.

It is previously specified that these conditions govern the contractual relationship between any user of the site jfl-art-du-bien-etre.com (hereinafter referred to as "The customer" or "the user") and Jean-François LECOCQ , (hereinafter referred to as "JFL" or "the artist" or "jfl-art-du-bien-etre.com"),
The client and the artist consider that the value of the work will increase in the future. The client and the artist recognize that it is desirable and fair for the artist to benefit from any added value that the work will be able to know.
No sale or order will be approved without reading and acceptance of this.

Article 1: Price

1.1 - The prices of the products are indicated in Euros, all taxes included, delivery included for Metropolitan France.

1.2 - In case of order to a country other than metropolitan France, you are the importer of the concerned works. For all works shipped outside the European Union and DOM-TOM, customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the Artist. They will be at your expense and are your sole responsibility both in terms of declarations and payments to the competent authorities and bodies of your country. We advise you to inquire about these aspects with your local authorities.

1.3 - The Artist reserves the right to modify its prices at any time. The products will be invoiced on the basis of the rates in force at the time of the registration of the orders, subject to availability.

1.4 - The products remain the property of the Artist, until full payment of the indicated price.

Article 2: Order

When you click on the validation button after the ordering process, you declare to accept this one as well as the entirety of the present General Conditions of Sale fully and without reserve.

We will confirm receipt of your order by sending an email.

The data recorded on jfl-art-du-bien-etre.com constitute the proof of all transactions made by the Artist and his clients.

The data recorded by the payment system is proof of financial transactions.

Article 3: Payment

The payment of your purchases is made in euros via Paypal. For any other payment method contact us directly.

Article 4: Terms of acceptance of the order

The order is deemed accepted by the Artist from the confirmation of the receipt of the order form, or the execution of work or collection.

Article 5: Cancellation

5.1 - In accordance with Article L121-20 of the Consumer Code, You have a right of withdrawal to return the work, or the object, which does not suit you.

For any order on jfl-art-du-bien-etre.com, you have a period of 14 calendar days to notify us of your return request.

For this, please contact Jean-François Lecocq who will indicate the return address and you will then have a period of 8 days to return your order.

Only the price of the purchased prints will be refunded, the return costs are your responsibility. Returns are to be made to Jean-François Lecocq, 6 Avenue Agricole Perdiguier, 84310 Morières-les-Avignon, in perfect condition, in their original packaging and accompanied by a copy of the invoice and if applicable the certificate of authenticity. If the product has been unpacked, a reduction of 20% of the price corresponding to the repackaging and delivery costs will be deducted from the refund. If the product has not been unpacked, a discount of 10% of the price corresponding to the delivery charge that was offered with the order.

5.2 - Refunds will be made within 15 days of receipt of the works by us. The refund will be made by credit to your bank account or by check sent to the name of the customer who placed the order and to the billing address.

5.3 - No COD shipment will be accepted for any reason.

Article 6: Clause of reservation and ownership and realization of the sale

The ordered works remain the property of Jean-François Lecocq until full payment of their price by the Customer.

It is agreed in all cases that Jean-François Lecocq remains wholly and unconditionally the holder of all his copyrights.

Article 7: Expedition

The order will be executed within thirty days at the latest, as of its acceptance by Jean-François Lecocq. The shipment of the work will be made in the format by mail, by specialized carrier, or any other mode and the delivery address indicated on jfl-art-du-bien-etre.com when ordering.

All parcels must be opened in the presence of the deliveryman. It is your responsibility, in case of default or damage, to issue precise and detailed reservations to the carrier at the time of delivery, specifying the details of the damage on the delivery note, in order to benefit from the insurance contracted . If the driver refuses to stay for the opening of the parcel, the parcel must be refused.

If these procedures are not followed, you will not be able to benefit from any refund or re-sending.

Article 8: Availability of works

In case of unavailability of the work, the Customer will be informed at the latest within 10 days from the acceptance of the order.

In this case, the order will be deemed canceled. The sums paid by the Customer at the time of the order will be refunded to him, unless the Artist proposes a replacement of the work that would be accepted by the Customer.

Article 9: Transfer of risks

The transfer of risks on the work will take place as soon as the carrier delivers it to the Customer.

Article 10: Force majeure

All events, of whatever nature, beyond the control of the Artist, having an unforeseeable character and tending to delay or prevent the execution of the Order constitute, by express agreement, a cause for suspension and / or termination of the obligations of the Artist towards the Customer, without compensation to the Client.

Without limiting the scope of the other provisions of these General Terms and Conditions of Sale, the Artist's liability, whether in tort or contract, can not be engaged for acts due to a fortuitous event or to the fact of a third party or the victim of the damage.

Article 11: Guarantees

11.1 - The Artist undertakes to respect all the mandatory legal guarantees.

The works are covered by a damage insurance during transport by the customer himself unless the delivery is made by the artist himself in his own hands. Acquisitions will be fully refunded in the event of damage occurring before or during delivery, without any liability whatsoever to the Artist.

11.2 - A certificate of authenticity signed by the Artist, guaranteeing the origin of the work will be sent to the Client with the work. No additional documents will be provided.

Article 12: Independence of clauses

If for any reason any of these General Terms and Conditions should be declared void or unenforceable, the invalidity or any defect affecting it shall not affect the application of the other provisions of the General Terms and Conditions. Any General Sales Conditions deemed inapplicable will then be replaced by the closest possible provision.

Article 13: Advertising

13.1 The name of the Artist will appear in the credits of the Work as the exclusive Author of the said Work in any form of sponsorship, on the parts of the client's website (if any).

13.2 The artist must be informed before any use of his work for all commercial, advertising, sponsorship and other purposes.

13.3 A link to the artist's personal website www.jfl-art-du-bien-etre.com will be established on the appropriate section of the client's website.

13.4 The Artist opposes any logo affixing that would be imposed by potential distributors of The Work and its direct or indirect derivatives.

13.5 All technological portings on other digital or non-digital media known or unknown to date must be submitted and performed by the Artist or a company of his choice for a billing for said service.

13.5 The artist reserves exclusively the products generated by the sale and exploitation of texts, images, sounds, graphics and programs of all kinds contained in the Work and which are his property except in agreement with the client. It also reserves the right to use these elements in other forms of publications.

Article 14: The right of reproduction, dissemination and adaptation

The reproduction right:

  • The artist reserves the right to record by any technical process known or unknown to date, on all digital media, in all the definitions and in all formats, using any framing report, still images or sequences animated, original sounds and dubbing, texts as well as computer programs representing the elements of the Work;

  • The artist reserves the right to establish or have established, in such number as it please, or to its successors, all originals, doubles, or copies, on all media known or unknown to date, including digital from his work;

  • The artist reserves the right to put or put in circulation these originals, doubles or copies, for the commercialization of the Work and all secondary or derived exploitations (posters, flyers, brochures, catalogs).

The diffusion must

  • The right to broadcast includes the right to broadcast or disseminate all or part of the Work in all countries, to all audiences, by all networks and by any process inherent in this mode of exploitation, on media (Off- Line) or online (On Line).

The right of adaptation

  • The artist reserves the right to adapt all or part of the work, including pre or post-publication, in modified, revised, condensed or extended form by the integration of new elements on all the material and any current or future system.

1- Secondary farms

The Artist may authorize the Purchaser who requests it:

A- The public representation in part of the sequences of the Work to ensure its promotion in all places, especially in any market, festival or promotional event.

B- The right to exploit all or part of the Work in the non-commercial sector, such as exploitation in the context of national or world cultural events.

Article 15: Nominative information

The information you provide us, in the registration form and your purchase order, or by any other means, may be the subject of computerized processing to allow the processing of your file, the security of payments, shipping of the commissioned work and the setting up of commercial actions. This information may, therefore and exclusively for the aforementioned purposes, be communicated, in France and abroad, to public bodies or private companies. By confirming your order, you authorize us to distribute them under these conditions.

In accordance with the law n ° 78-17 of January 6, 1978 (data processing and liberties), you can access this information, ask for their modification or rectification or require to no longer appear in our database. Article 16: Applicable law and disputes

Works of art, objects are governed by Code of Intellectual Property. The present contract is regulated by French law.
